The log files include such things as a list of all the pages visited; the type of browser used by the visitor, and from where the visitor was referred to the Site. If you are not logged in, this is all anonymous.

Cookies
A cookie is a small piece of information that your browser can store on behalf of a Web site. At this time, The Track Group does not use cookies to track visitors to the Site.

Section 508 address people with the following types of disabilities:

Some specific sections of Section 508 most relevant to multimedia, software, and Web-based applications include:
1194.24 Video and multimedia products.
(a) All analog television displays 13 inches and larger, and computer equipment that includes analog television receiver or display circuitry, shall be equipped with caption decoder circuitry which appropriately receives, decodes, and displays closed captions from broadcast, cable, videotape, and DVD signals. As soon as practicable, but not later than July 1, 2002, widescreen digital television (DTV) displays measuring at least 7.8 inches vertically, DTV sets with conventional displays measuring at least 13 inches vertically, and stand-alone DTV tuners, whether or not they are marketed with display screens, and computer equipment that includes DTV receiver or display circuitry, shall be equipped with caption decoder circuitry which appropriately receives, decodes, and displays closed captions from broadcast, cable, videotape, and DVD signals.
(b) All training and informational video and multimedia productions which support the agency's mission, regardless of format, that contain speech or other audio information necessary for the comprehension of the content, shall be open or closed captioned.
(c) All training and informational video and multimedia productions which support the agency's mission, regardless of format, that contain visual information necessary for the comprehension of the content, shall be audio described.
(d) Display or presentation of alternate text presentation or audio descriptions shall be user-selectable unless permanent.
 
Subpart B -- Technical Standards
1194.21 Software applications and operating systems.
(a) When software is designed to run on a system that has a keyboard, product functions shall be executable from a keyboard where the function itself or the result of performing a function can be discerned textually.
(b) Applications shall not disrupt or disable activated features of other products that are identified as accessibility features, where those features are developed and documented according to industry standards. Applications also shall not disrupt or disable activated features of any operating system that are identified as accessibility features where the application programming interface for those accessibility features has been documented by the manufacturer of the operating system and is available to the product developer.
(c) A well-defined on-screen indication of the current focus shall be provided that moves among interactive interface elements as the input focus changes. The focus shall be programmatically exposed so that assistive technology can track focus and focus changes.
(d) Sufficient information about a user interface element including the identity, operation and state of the element shall be available to assistive technology. When an image represents a program element, the information conveyed by the image must also be available in text.
(e) When bitmap images are used to identify controls, status indicators, or other programmatic elements, the meaning assigned to those images shall be consistent throughout an application's performance.
(f) Textual information shall be provided through operating system functions for displaying text. The minimum information that shall be made available is text content, text input caret location, and text attributes.
(g) Applications shall not override user selected contrast and color selections and other individual display attributes.
(h When animation is displayed, the information shall be displayable in at least one non-animated presentation mode at the option of the user.
(i) Color coding shall not be used as the only means of conveying information, indicating an action, prompting a response, or distinguishing a visual element.
(j) When a product permits a user to adjust color and contrast settings, a variety of color selections capable of producing a range of contrast levels shall be provided.
(k) Software shall not use flashing or blinking text, objects, or other elements having a flash or blink frequency greater than 2 Hz and lower than 55 Hz.
(l) When electronic forms are used, the form shall allow people using assistive technology to access the information, field elements, and functionality required for completion and submission of the form, including all directions and cues.
   
 
1194.22 Web-based intranet and internet information and applications.
(a) A text equivalent for every non-text element shall be provided (e.g., via "alt", "longdesc", or in element content).
(b) Equivalent alternatives for any multimedia presentation shall be synchronized with the presentation.
(c) Web pages shall be designed so that all information conveyed with color is also available without color, for example from context or markup.
(d) Documents shall be organized so they are readable without requiring an associated style sheet.
(e) Redundant text links shall be provided for each active region of a server-side image map.
(f) Client-side image maps shall be provided instead of server-side image maps except where the regions cannot be defined with an available geometric shape.
(g) Row and column headers shall be identified for data tables.
(h Markup shall be used to associate data cells and header cells for data tables that have two or more logical levels of row or column headers.
(i) Frames shall be titled with text that facilitates frame identification and navigation.
(j) Pages shall be designed to avoid causing the screen to flicker with a frequency greater than 2 Hz and lower than 55 Hz.
(k) A text-only page, with equivalent information or functionality, shall be provided to make a Web site comply with the provisions of this part, when compliance cannot be accomplished in any other way. The content of the text-only page shall be updated whenever the primary page changes.
(l) When pages utilize scripting languages to display content, or to create interface elements, the information provided by the script shall be identified with functional text that can be read by assistive technology.
(m) When a Web page requires that an applet, plug-in or other application be present on the client system to interpret page content, the page must provide a link to a plug-in or applet that complies with §1194.21(a) through (l).
(n When electronic forms are designed to be completed online, the form shall allow people using assistive technology to access the information, field elements, and functionality required for completion and submission of the form, including all directions and cues.
(o) A method shall be provided that permits users to skip repetitive navigation links.
(p) When a timed response is required, the user shall be alerted and given sufficient time to indicate more time is required.

TERMS AND CONDITIONS
The following terms and conditions apply to multimedia projects:

ADDITIONAL WORK ORDERS – The base cost includes select items as listed in specifications pages. The charge to add additional items is listed and only applies if your project requires more than the items included in the base. Client permission will be obtained prior to committing to work that goes beyond the base cost.

CHANGE FEE – Once client approval is given for specific stages as indicated, there will be a charge for any changes made after the approval is granted. Approval will be given either via e-mail, fax, or Web forms. The amount of the additional charge will depend on the scope of the change and an exact cost will be given to the client for approval prior to any new work being performed.

CANCELLATION / REFUNDS – Payments for design, programming, and other technical or creative work are non refundable. If the project is cancelled by the client prior to preparation of a golden master, any milestones already completed by Track will be invoiced on a pro-rated basis based on the percentage of work completed.

PRORATING OF BASE COST – The items included in the base cost specify “up to” figures and there is no reduction in the base cost if fewer items are actually used than estimated in the budget.

GOLDEN MASTER DELIVERY – To fulfill the contract, the items to be delivered for the base cost include the files necessary to run the presentation as specified in the design and navigation stages. These files will be provided on a single CD-ROM and if Web copy is included, the Web files will be provided on a single CD-ROM. Track holds the exclusive copyright on the presentation until payment is received in full.

DELIVERED AS-IS – The golden master version will be made available to the client to test on various PCs. While Track does test the software on a variety of PCs and has a quality assurance process, Track delivers the golden master “as-is” and does not provide a guarantee of usability on any specific computer. Due to the nature of software and the interaction with a wide variety of hardware and operating systems, the potential for problems will always be there. This means that any specific feature or attribute of the program may not work on any specific computer or may not work as intended.

If an error is discovered prior to starting replication and the client desires Track to spend the time to troubleshoot the problem, Track will attempt to locate the cause of the error. If the error cannot be solved, if the software works on other PCs, or if the error is not such that it would have a great impact on the overall user experience, then the client has the option to either move ahead with replication or terminate. Full payment would still be due for the base cost, but no replication charges would be incurred. Once the golden master is approved by the client and replication has started, Track cannot be responsible for the discovery of any errors and will not provide a refund of replication fees paid or due. This clause is true regardless of whether the fault of the problem is due to an error or oversight made by Track, the client, or a sub-contractor of Track.

WARRANTY – If a fundamental error that has an impact on the ability for a majority of people using PC operating systems that are not older than three years to operate the CD is discovered anytime within three months of the delivery date is discovered and presented to Track, these errors will be covered under this warranty. If a resolution cannot be obtained, the buyer may be entitled to a partial refund of the base cost as negotiated with Track. Track will not refund any money paid for replication, mailing, shipping, postage, or due to any other related loss due to not having a fully functioning presentation. Track cannot provide any warranty on software issues related to the programming platforms used to generate the presentation.

SOURCE FILES – Track will keep the source files necessary to make future changes to the presentation for a period of at least one year. Track is not responsible if some or all of the source files are lost or damaged and not available in the future.

DELIVERY DATES – Track does not guarantee a specific delivery due date for this project. Once the navigation map is approved by the client, Track will provide an estimated schedule that makes assumptions to arrive at a potential delivery date. All dates are subject to change and contingent on rapid client approval at each stage and prompt delivery of any client assets such as scripts, copy, and photographs and are subject to change due to factors outside of the control of Track including software problems. Track will begin working on this project within one week of client approval of the contract.

Every attempt will be made to honor estimated due dates. The average time necessary to complete a project is 30 days with less than 10 minutes of video and a scheduled video shoot within one week of starting the job. Track reserves the right to charge a monthly fee of up to $500 for projects that extend beyond three months due to client delays unless the project is put on hold completely. A charge of 2% per month will be added to invoices not paid within 30 days of invoice date.

CLIENT POINT OF CONTACT – The client will make a single point of contact (POC) available to Track for the period of this project. The POC has sole authorization to speak on behalf of the client regarding approvals, request for changes, or requests for additional work including additional commitments of payment that are authorized by the client’s organization. The POC may elect to transfer this responsibility to another person within the client’s company and in this case will share all of the project history upon transfer.

COPYRIGHT MATERIAL – It is the client’s responsibility to obtain permission to reproduce or use any material provided by the client to Track for inclusion in this project. This includes written copy, graphics, videos, audio recordings, logos, and anything else provided. The client accepts full responsibility for any legal action that may be brought forth as a result of using copyright-protected property that the client provided to Track.

LIMITATION OF LIABILITY – Subject to the client’s obligation to pay the price to Track, either party’s liability in contract, tort, or otherwise (including negligence) arising directly out of or in connection with this Agreement or the performance or observance of its obligations under this Agreement and every applicable part of it shall be limited in aggregate to the price. To the extent it is lawful to exclude the following heads of loss and subject to the client’s obligation to pay the price, in no event shall either party be liable for any loss of profits, goodwill, loss of business, loss of data, or any other indirect or consequential loss or damage whatsoever.

RELATIONSHIP OF THE PARTIES – The Parties acknowledge and agree that the services performed by Track, its employees, agents, or sub-contractors shall be as an independent contractor and that nothing in this Agreement shall be deemed to constitute a partnership, joint venture, agency relationship, or otherwise between the parties.

CONFIDENTIALITY – Neither Party will use, copy, adapt, alter, or part with possession of any information of the other which is disclosed or otherwise comes into its possession under or in relation to this Agreement and which is of a confidential nature. This obligation will not apply to information which the recipient can prove was in its possession at the date it was received or obtained or which the recipient obtains from some other person with good legal title to it or which is in or comes into the public domain otherwise than through the default or negligence of the recipient or which is independently developed by or for the recipient.

MISCELLANEOUS – The failure of either party to enforce its rights under this Agreement at any time for any period shall not be construed as a waiver of such rights. If any part, term, or provision of this Agreement is held to be illegal or unenforceable, then neither the validity nor enforceability of the remainder of this Agreement shall be affected. Neither Party shall assign or transfer all or any part of its rights under this Agreement without the consent of the other Party. This Agreement may not be amended for any other reason without the prior written agreement of both Parties. This Agreement constitutes the entire understanding between the Parties relating to the subject matter hereof unless any representation or warranty made about this Agreement was made fraudulently and, save as may be expressly referred to or referenced herein, supersedes all prior representations, writings, negotiations, or understandings with respect hereto. Neither Party shall be liable for failure to perform or delay in performing any obligation under this Agreement if the failure or delay is caused by any circumstances beyond its reasonable control, including, but not limited to, acts of god, war, civil commotion, or industrial dispute. If such delay or failure continues for at least seven days, the Party not affected by such delay or failure shall be entitled to terminate this Agreement by notice in writing to the other.
